Staff in third-party funded projects, general principles
All staff actions and measures must be handled by the Human Resources Division. Forms for employment can also be found on the pages of the Human Resources Division. The hiring of employees on the basis of third-party funds handled via the state budget takes place without exception in an employment contract with the State of Baden-Württemberg and is subject to applicable collective agreements. The Vice-President for Finance and Personnel alone is responsible for the conclusion of employment contracts.
No additional payments may be made to public sector employees, independently of whether they receive their salaries from posts included in the state budget or from third parties. No exceptions are possible by decision of the employer. Remuneration under §11(1 and 2) LBesG (Baden-Württemberg Remuneration Act) in relation to §11b(3) LBesG (also covering a research supplement in the case of contract research), overtime payment and supplements are only allowed subject to statutory prerequisites or collective agreements.
Staff costs
Third-party funds must cover all staff costs including the employer’s share of social insurance and allocations for additional old-age and survivor pensions and the general taxes due, gratuities, holiday allowances and capital-forming benefits. Staff cost calculation shall also cover all possible staff secondary costs (e.g. health insurance assistance, travel and removal cost payment, severance pay, meals subsidy, costs for medical checkups on hiring and for radiation protection).
When drawing up the budget for the application and when concluding the contract, the applicant must see to it that the funding body commits to covering all staff expenses.

Recent legislation on temporary contracts at research institutions no longer allows for limiting the contracts of non-academic personnel for the duration of a third-party funded project. In such a case, it is only possible to limit contracts according to the provisions of the law on part-time and limited contracts. The Human Resources Division can advise on this matter.
